  • How to get GC with my L1B visa

    Hi guys. My company filled for my L1-B extension and i got RFE and my GC is also in parallel. Currently it's under job posting stage. After this my company will file for my PERM application and I-140 premium & I-485 in parallel using cross chargibility. My question as follows

    1. Assuming my L1-B is denied , can i still stay in US using my B1 visa ?

    2. If i can't stay in B1 can you please suggest some other way for me to get my GC here in US itself instead of going to India and doing it as consular notification ?

    3. I need to stay here in US , since i heard after my I-485 it hardly takes 4-6 months to get a GC.

    Or is Consular Processing my only option assuming my L1 is denied ? . I am so depressed and sad because i know my GC is so near but still i cannot reach it because of my L1 visa. One of friend L1 visa was denied after RFE, he also work in the same company. Any suggestions or advice would help me a lot guys.

    Yes, you can file for COS.

    You can stay, but you'll need to provide a good reason to switch to B1, applying for your I485 is not a valid reason for switching to B1.

    Need more information to suggest on this. Which category your GC is filed, your nationality & priority date (if any).​​​​​​​

    ​​​​​​​Well, you need to maintain a valid status if you are staying in USA, be it L1 or B1 or anything else.

    Need date for your initial L1, extension, priority etc.

      Really thank you so much for your response. As said my GC is in PERM job posting stage after this my PERM application will be applied and only after that i will get my priority date. My L1 RFE was received on April 24,2020 hence my attorney said along with normal response time which is 3 months i will get an additional 60 days grace since i got RFE during COVID-19.

      Reg my GC i am a Indian and my Wife is a Srilankan hence my attorney said using cross charegibility i will get my GC much faster since my priority will become current. They said they will file I-140 & I-485 on the same date. Recently one of friend L1-B visa got denied after his RFE. Hence i am so worried

        As per current situation, PERM, I140 & then I1485 will still take 4-6 months easily.
