    Hi Everyone,

    I need some information that will help me a lot to decide my approach towards job search nd Visa processing-
    I was working in india and my employer selected me for H1 visa processing, i got selected in h1 lottery, and petition got approved.
    But didn’t go for stamping of H1. Then I had to leave that employer and travelled to USA on L2 visa. Now I am holding L2 EAD, going to join new job where I see possibility of H1 processing.
    my question is - my h1 petition that was approved with previous employer, does that have any consideration?
    Can previous lottery selection help/have impact/advantage anyhow if my current employer decide to process my H1..
    note- I didn’t receive any details of H1 petition from my previous employer.

    Yes, your new employer will need to file for your new cap-exempt H1 petition - provided your earlier petition is not expired (6 years).

    Yes, you'll be cap-exempt - need not to go through lottery etc, can file anytime. You need to have hard copy of I797 from your previous employer.

      Thank you for the reply. But my previous employer denied to provide any details. Can attorney or my current company find out the petition details from USCIS?
