L1A petition expired but I-94 not expired, can I work beyond 240 days?

  • L1A petition expired but I-94 not expired, can I work beyond 240 days?

    Hello All, could you please help with below based on your expertise and experiences?

    - My L1A petition got expired in Nov 2019 and extension is in progress till now which was filed in timely manner before petition expiry. My current i-94 expiration date is Dec 2021. The 240 days work authorization window beyond petition expiry date ends later this month. Would I be able to continue work beyond 240 days due to valid i-94?

    No, a valid I94 only gives you stay, but not authority to work. You can stay in USA till Dec 21, but cannot work after 240 days of your petition expiry, until you get your approval.

      Thanks Libra_14 for the response. I was also having the same understanding however I got confused going through below documentation on USCIS site about work authorization. On page 3, it states below. It talks about 240 days from I-94 expiry and not petition expiry.

      You may be required to stop working
      immediately when the first of the following events occurs:
      • 240 days elapses from the date your I-94 expires; or
      • USCIS has made a final decision denying your extension
      application.

        Yes, this is misleading information. Generally I94 for L visa are always matching to your petition expiry date.
