L1B Denied,any chances to file extension and stay for limited period due to Covid 19

  • L1B Denied,any chances to file extension and stay for limited period due to Covid 19

    Hi All,
    My L1B Visa Expired on March 1st 2020,My I94 and Petion also Expired on Same date.
    and my company filed for Visa Extension, received RFE and responded it. but my Bad luck it got Denied on July 13th2020. what are other options to stay in USA for limited time due to Covid 19.
    what is the way to file one more extension? do I need to back and file from India? Do I need to Stay at least 1 year in India for filing new L1A/L1B? Please suggest.

    Since your earlier petition is already expired on March 1st 2020 - you cannot file for "extension" again. An "expired" petition cannot be extended.

    You can switch to B2 visa & continue to stay in USA until this pandemic situation is over, but you cannot work in absence of a valid petition.

    For new L1A petition you'll need to wait for an year outside USA.

      HI,
      Do I get new I 94 with Denial letter? If I am going to Switch to B2, will it be a problem to file new L1A or L1B from India? till when I Can Switch to B2..

        It depends on the reason of denial. You may or may not get a new I94.

          Hi ijalab I have also applied for L1B extension just to check what was the rfe and reason of denial. Was it under normal or premium processing. Thanks

            hi Jugal, its regular process only, RFE Is basically , they are asking proofs about Specialization Knowledge.

              I did not get New I 94 With denial letter,and I Current I 94 Expired on March 1st 2020. If I apply as motion, can I stay here in US till get the result. Am I eligible to work during that process.

                  Consult an attorney, I guess you need to leave the country as soon as possible or switch to B2.

                    HI, due L1 Visa Extension Denial and I 94 Expired I have to travel back India, but due to Corona pandemic I would like to avoid my travel at this moment.
                    As I have Valid B1 Visa, Can I stay with that visa, IS it Possible to change the status of Family from L2 To B2 By using that B1 Visa.
