  • Green card I-485 filing and getting in current condition after PD being current

    Hi!

Hope people are doing well in current situation. I am having couple of questions.
I was wondering if I may file I-485 form, as my PD is current. Will President’s order of not issuing GC impact in the process?

Is it current on USCIS's chart?

This is my personal opinion and is not to be construed as legal advice.

Since you are talking about filing AOS (I485), I assuming that you are in USA right now. If yes, you can file for I485 right now.

The President's order is only for people outside USA right now.

I could have been elaborated a bit more. I am in India. I was in US from 2016 thru 2019 on L1A visa. My I-140 is approved and PD is of April 2018. However, date was not current at that time for I-485 filing. My visa extension was denied and I came back in Dec’19.
Now, PD is current and was wondering what would be path whether to apply I-485 or first apply fresh L1 and then go for I-485 filing. What is the best way to go for, as USCIS may see previous extension denial.

Since you are outside USA right now, you'll have to go through counselor processing:
          https://www.uscis.gov/green-card/gre...ment-of-status

Which is on hold as of now.

Why did your L1 petition extension get denied? and what makes you think that a fresh L1 petition will be approved?

I just want to understand risk factor. As my earlier extension was denied due to having functional and people manager role, as against initial petition showing people manager. They dictated that I am not manager despite having all proof represented for my functional and people manager responsibility in RFE.
so what option would be better for me with better chance of approval; going for fresh L1A first and then AOS or directly filing AOS in consulate once it opens.

I would like to know whether I may apply for AOS in USA, once I come on business visa.

You can enter on H or L work visa with intent to do AOS once you are in the US. You cannot enter on any other type of nonimmigrant visa with intent to do AOS once you are in the US.
