  • Filing L1 extension for child without co parent

Hi, my current situation - I’m on L1A visa expiring Nov 2020 and my 4 yr old kid is my dependent. My wife is on F1 visa expiring Feb 2021. If I file my visa extension along with my kid, will there be questions from uscis asking how the kid is here without the mother ? Since I’m not applying dependent visa for my wife as it will be a change of status of her and the approval takes more than a year . Pls advise what has to be done !

can I file for extension with my kid or just for myself .

You can file for an extension for yourself and any dependents who need it. Mother's status is irrelevant.
Just an opinion; Not legal advice.

If USCIS questioned you on that, that would be discrimination based on gender- fathers can raise children on their own. You can file the L-1 and L-2 extension together.
