  • Rejoining through L1-Individual

    I worked with Company A for 3 years till feb 2010 in India
    From Feb till May I worked for Company B in India and meanwhile I was offered by Company A directly as an US employee.
    So I quit Company B and now I am to attend Visa Interview for L1-Individual sponsored by Company A.
    I am Unemployed right now.
    Do I have to be employed by Company A before I appear for L1-Individual Visa?
    (Earlier in May my L1 Blanket for Company A was rejected under 221(g) and at that time I was working for Company B.)
    Please advice.

    L1 is an intra company transfer visa. The applicant must be coming to U.S to provide service to the same employer. If you are not employed right now, then L1 is not a option for you. Probably the company should apply H1B.

      I appeared for the L1 interview for the said case in this mail thread.They collected my passport at the consulate and was given a blue slip marked for "Your application requires additional administrative processing before a final decision can be made".
      My case officer at the consulate told they need to check whether it is legal to be unemployed (even though i prior worked with company A) while appearing for L1.They are to check the US law and get back to me.

      Now my questions are:

      1) Considering if my case is legally correct,what would be the waiting time for me to get my passport back stamped with Visa?
      2) Since they have collected my passport should i assume my Visa Interview is over and there would be no more scheduling in the future?

        >>> L1 is an intra company transfer visa. Unless you are currently employed, I don't think L1 is possible. Please update the forum if you get the visa stamped. As each case is different, the time to get the 221g processing completed is different for each case. No one can predict it.

        >>> Most likely your visa interview is done. You will have to wait for their decision now. However, there are cases (very few) where the consulate has asked the candidate to appear again for the interview.

          Shervin,
          I got my Visa Stamped
          Got my passport via courier today.
          I understand mine is a corner case and it will be a learning hence updating its final leg.
