  • L1 individual visa stamping (passport expiring soon)

    Hello All,

    I am scheduled to appear for my Visa interview by end of July,2010 for my L1 individual extension petition which is approved. The approved petition is from 6th April,2010 to 6th April,2012.

    However my passport expires sometime in July,2011. I hope the visa stamping will be till 2012? Correct?

    Also, i was planning to come back to US on this visa and then get my passport renewed from NY. Then whenever i travel back and forth from US to India i can carry both the old and new passport since old passport would have the actual visa.

      The question is :

      a) Will visa stamp be till 2012?
      b) Can i travel multiple times b/w India and US using the old and new pp?
      c) After i get new passport done in US, would i have to update the I-94 since it would reference the old pp number?

        a) Will visa stamp be till 2012?
        >>> There are more chances that your visa will be stamped until the petition expiry date as your passport is valid for more than an year. But some VO's tend to give visa only till the passport expiry date (Eventhough the petition is valid for a longer duration than the passport). Even if you get the visa until 2012, the officer at POE might give you an I-94 only till the passport expiry date. But like I mentioned before, the chances of that happening is less. It totally depends on the offers you meet.

        b) Can i travel multiple times b/w India and US using the old and new pp?
        >>> Yes. As long as the visa remains valid in the old passport, you can travel with both the passports.

        c) After i get new passport done in US, would i have to update the I-94 since it would reference the old pp number?
        >>> Not required as your will be carrying both the passports while travelling.
