Stranded in India. Expired L1/L2 Visa. How to return to US. Need inputs

  • Stranded in India. Expired L1/L2 Visa. How to return to US. Need inputs

    Hi all

    Posting this to seek advice.

    Let me summarize my situation -

    - I work in NYC for a large bank in a managerial post. L1A visa. Indian citizen. L1A work order extended till May 2022.
    - Visited India in March on a personal visit. Got stranded because of Covid. Couldn't return as planned. Visa expired on May 31st
    - Consulates not processing visa stamping. So not able to return to US. Working from home out of India
    - GC process ongoing. Priority date of Aug 2017 is now current (EB1-C process)
    - Wife in US. Need to join her

    Options for me

    - Travel to US on B1/B2 visa (which is valid in my passport). I cannot work on B1/B2. But that is ok, as I cannot work out of India anyway beyond end of September as per company policy
    - Once I reach US, I will wait for my GC. If I get the GC soon, I can travel to Canada using GC, and re-enter US with the Green card, which should permit me to resume work in US

    Things on which I need input -

    1. Can I travel to US on B1/B2 hassle free now? Are there any questions I will face at immigration?
    2. My priority date of Aug 2017 is now current for the Green card. When can I realistically expect the Green card to arrive?

    You can certainly travel to USA on B1 visa, however high chances you will be called for secondary interview. Having an intention to migrate to USA is not allowed on B1 visa.

    People around that priority date started getting their GCs shipped. Don't you have your EAD/AP card with you?

      Thanks for your input!

      I had an EAD / AP card with me. But it expired in 2019. I did not renew.
