  • L1A Individual unannounced audit

    Hello,

Has anyone experienced an unannounced audit for "L1A" visa. Does it happen for only approved visas or can it also happen when the extension is in progress?

Once an visa is approved, then there won't be any audit - if that happens you can sue USCIS to going against their own decision.

Generally audit happens when the extension is in process.

Not true. Worksite audits can be unannounced and at any time. An approved visa is subject for denial (NOID) just as a renewal is.
The purpose of these worksite audits is to check if the employee records are properly maintained by HR, to interview the beneficiary on what he / she does + what HR has on file v/s what was submitted to the USCIS for that petition.
Some audits are just random v/s others that are targeted due to previous violations or tips

I was audited after approving my first extension. They have all freedom to do the audit whenever they like.
