  • I140 Filing after EAD expiry

    I am in L2B and my visa is expiring December 1, 2020. My employer is sponsoring GC and will file I140 & I485 concurrently (eligible to file I485) but my EAD will expire soon. Is it possible to file I140 & I485 after the expiration of L2B EAD? I will be able to stay in US legally but there will be gap in L2 EAD.

    I140 can be filed anytime. But for I485 you need to be in USA on a valid status (i.e. L2). Your current L2-EAD doesn't have anything to do with your GC process.

    However you won't be able to work until you have your renewed EAD in hand.
