  • L1 Visa Expiring - Any Options to Conitnue in USA

    My L1Visa will be expiring in OCT 2010 (around 4 months). I have stayed 5 years on this visa. My employee is not ready to file my GC. How can I stay in USA further:

    - My wife also has L1 visa, can I come on L2 Visa and work in USA.

    - Can I ask my employeer to file a H1B non-cap VISA.

    >>> It should be a CAP counted H1B and you will get only 1 more year.

      L1B queries

      I have an offer of the company sponsoring the L1B visa this month. I have a list of queries related to that.

      1. How many days does it take to get the L1b visa?

      2. Can I study Full-Time (MBA) while on the L1B visa?

      3. Do I get a LC or EAD automatically while filling for a L1B?

      4. Can I apply for a GC? If yes whats the procedure? I heard while you are in the process of getting a GC, you can remain in the US even if the L1B visa is over?

      5. What would you suggest, converting a L1B to a H1B or L1B to a GC? If yes then the procedure.

          Hi,

          As you don't want to go to your home country.
          One option is: Get your H1 visa (get a sponsoring company and change your job)- you can join this h1b company only on Oct 2010, and have them file for your green card in a month(you can negotiate this at the time of offer).

          This way you will stay for another year on your h1 and then on your green card extension till you get your green card.
          Of course it has many ifs and but.

          Remember that you cannot stay more than 6 years on your l1/h1 visa in USA unless you have filed for your Greencard before the end of 5th year.
