L1 to H1 and New L1

  • L1 to H1 and New L1

    Last year I was in L1 and got trasnfered my L1 to H1 and it got approved.

    While my H1 stauts was apporved i was in india.

    My L1 employer applied new L1 and send me again for different client

    Now i am thinking of going back to india and come on H1. My doubt is the old L1 pettiton which was transfered to H1 is still be valid or not and if i need to work on H1 what i need to do

    Can somebody please help on this?

    Check the validity of the H1B petition in I-797 approval notice. The petition remains valid until it's expiry date unless revoked by the employer. You can get the H1B stamped and return back in H1B visa to be in H1B status. Listed below are the documents required to get the H1B stamped.

      Thanks a lot for your reply.

      Do i have to go back to india to get the stamping?

      is thre any alternate for getting stamped or changing to H1 status without going back to india

        You can ask your H1B employer to file a COS from L1 to H1B. If the COS gets approved, you can start working for the H1B employer without having to get the H1b stamped.

        If you decide to get the H1B stamped and if this is your first time H1B stamping, then it is advisable to get it done in your home country, unless you have done your masters in U.S.
