  • L1B Visa Extension, L2 Visa ?

    Hello,

    I hold L1B visa that is going to expire on Nov 4th, 2010 and my employer has filed an extension and I am asked to go india for my stamping done by September, 2010

    As my spouse L2 visa also expires the same date.

    My question is does my spouse (on L2 visa with me in USA) requires to travel India for Re - stamping for L2 Visa or can it be done when I return back with my new visa?

    Thanks for your help.

    Visa is just an entry document. You don't need a valid visa to stay in the country. What is important is your I-94. If the approval comes with a valid I-94, you can continue to stay in the country and keep working. It's the same for L2 as well. You need a valid visa only when you go out of the country and decide to re-enter.

      Your spouse can file an I-539 to extend his/her status after your extension petition is approved.
