  • L2 Visa Extension & L2 EAD processing timelines

    Dear All,

    Help!!!!!!

I'm currently on L2 Visa which is going to expire on Dec 28, 2020 and so is my EAD. My husband's employer files L1A extension( premium processing) and L2 extension and EAD in month of June'20. My husband got his L1A extension in a month however I didn't received extension on my L2 visa yet, says " your case has received" . We filled expedite request for both my L2 visa and EAD extension but all the expedite requests are denied. L2 Visa extension I-539 is filled at California Service center and my EAD is at Vermont Service center.

Also, our I-140 is approved under EB-1 category and waiting for I-485 receipt notice to get the EAD.

Could you please help with your experience how much more time I need to wait to have my L2 visa extended. Since embassies are closed, we can't go for stamping to home country too and USCIS is not helping to expedite my case. It's so frustrating and everything is so uncertain.

    Appreciate your help!!!

    Thanks!!

Yeah, that's the case with everyone. USCIS is currently having a huge backlog because of the pandemic & huge number of applications they are receiving right now.

Check L2 extension processing time, its showing ~10 months for L2 extension for California service center & after that only your EAD will be approved.

Had the same problem here, my L1-B extension petition was filed in September 2020 with premium processing, was eventually approved after an RFE in December 2020 (the 2 month wait, despite premium processing, was our fault for taking ages to respond to the RFE, not USCIS's). My partner's L2 extension request and EAD renewal was filed at the same time, and we've had no update other than it was received in Texas on 16th Sept.

The situation is absurd, forcing people into unemployment for months for what should be a simple formality. It's severely affected our household income and makes me wonder whether it's worth staying here for another round of renewals. The worst thing is we can't even travel home in the interim.

I am in a similar situation.
My L1B visa, my wife's L2 visa and EAD with be expiring (we are planning to file as soon as we get into the 180 days bracket)
This is one of the most informative threads on this topic : https://www.immihelp.com/forum/usa-l...on-in-progress

However, it is a bit old and as per the rules that have changed after the aforesaid thread, the L2 extension is now processed separately from the L1 extension (due to requiring biometrics submitted for specifically the L2 extension purpose).

I have 1 question for L2 EAD extension. I understand that L2 EAD extension can be filed in one of the following 2 ways :
Scenario 1 : Request the employer to include the L2 EAD extension application (i-765) alongwith the L1 and L2 extension applications (i.e I-129 and I-539 applications) OR
Scenario 2 : Let the employer file the L1 and L2 extension applications (i.e I-129 and I-539 applications). Once the receipt number is available, use that to file L2 EAD extension application (i-765)

        Question :
Assuming that L1 extension gets approved, and subsequent to that L2 extension gets approved, is there a difference in processing time for L2 EAD extension for the 2 scenarios above i.e. will Scenario 1 lead to a faster processing when compared to Scenario 2 ?
Based on the other thread (cited earlier), it seems Scenario 2 leads to a RFE once L1 and L2 extensions are approved, which will likely add some delays.
It is also not clear if USCIS adjudicates both L2 and EAD extensions together in either of the 2 scenarios or starts processing EAD extension only after L2 extension is granted.

Sad, but its true - I guess the main reason, is that only primary applicant was qualified for an L visa (dependents are extra for US govt.).

Yes, scenario 1 will be faster.

          Most likely

No, each applications are processed individually.

Your situation is the same as mine. It spent 8 months to get my L2 extension and EAD renewed in Taxes Service center. You can do nothing but wait.

How long did it take you to get your biometrics appointment?
