L2 - EAD expires next week! Can I work?

My EAD card expires 01/16/2021. I applied for an extension and got the I797c 10/26/2020. My case still "Case Received"

My company asked for the I9 verification, I do not have a valid EAD at this time since it will expire next week. Can they use my I94 and foreign passport as a proof? Can I work with that?

I’m not sure how can you work on L2 without having valid EAD. Your visa may be valid but you can’t work on L2. Visa without EAD. Pls discuss with your attorney also and check.

No, you cannot work after your EAD expires. L2 EAD extension is dependent on L2 status extension, and is not one of the categories of EADs that have automatic extension of work authorization while renewal is pending. You will not have documents that can pass the I-9 until you get your new EAD. Using foreign passport and I-94 as a List A document for the I-9 is only for work statuses that allow you to work for a specific employer (like H1b, L1, etc.); it does not apply to L2 like you.
