Planning vacation with 3 months of i94 Validity and pregnant Wife

Hello,

I am currently on L1-B visa with a i94 expiry of May-20-2021. I am yet to initiate my extension process and planning to submit extension in the first week of April. My wife is pregnant and we are planning to travel to India for vacation by the month of March which is 6th month of her pregnancy and planning to return before the 6th month completion. I have couple of queries.


1. With my i94 valid until May-20-2021, will there be any issue when I re enter into USA after my vacation by March-30-2021 ?
2. As my wife will be around 6 months pregnant, will there be any questions or denial of entry due to less validity of my visa , becoz the delivery date is somewhere around July-2021.

Once you leave USA, your I94 will be gone. You'll most probably get a new I94 upon your return. in short, your current I94 has nothing to do with your re-entry.

No. But to be on safer side, keep proof handy during interview at POE to prove that you were already living in USA & not just planning to enter USA to give birth to your child on USA soil (just in case if they ask).
