  • L2 Visa initiation when L1 petition extension is in progress

    Currently my L1 extension has been filed at USCIS and it will most probably take atleast 2 months to get the approval notice.

    I am cuurently in US and I would like to bring my wife here but she does not have any Visa.

    Questions:

    1. When exactly can I initiate L2 visa for her? Can it only be done after my approval notice is available? or it can be done once I get the ack file number back from USCIS?

    2. Approximately how much time it takes to get approval noticec from USCIS?

    >>> L2 visa will be issued with an expiry date matching your L1 petition. So wait for your L1 extension to get approved and then ask your wife to go for the L2 stamping. If she goes for stamping now, it will be based on your current L1 petition and the visa will be issued for a shorter duration (assuming your current petition is still valid).

    2. Approximately how much time it takes to get approval noticec from USCIS?
    >>> 2-3 months by normal process and 15 days by premium.

      Actually my company's immigration staffs informed that once you apply for extension your existing visa will no longer be valid. Is it true? My Visa was valid till 15th Sep,2010 but since extension is filed does that mean it is now invalidated?

      Is there any way to get premium service for extension processing? how can I get that?

        >>> That is not true. Visa is valid until it's expiry date (check your passport). With respect to your previous question, your visa has got nothing to do with your wife's H4 visa. Your L1 petition is what is important.

        Is there any way to get premium service for extension processing? how can I get that?
        >>> You can go for premium process by paying an additional $1000. Check with your employer and they should be able to help you convert your application from normal to premium.
