  • L1A to Green Card

    Hi All,

I had a question on L1A to GC process. I am on L1a and into my 3rd year stay in the US. I have a renewal coming up later this year and my company is saying they will start the process of GC in 2022 which will be my fourth year. Does this mean I cannot file the GC under EB1C as I read somewhere that I need to be employed outside USA in managerial capacity in 1 out of last 3 years? Please let me know as I am only going to go for the GC if its under EB1 category.

    Thanks,
    A

You must have been employed outside the United States for at least 1 year in the 3 years preceding the petition or the most recent lawful nonimmigrant admission if you are already working for the U.S. petitioning employer.

You are eligible to apply for EB1C.
