  • L1 Visa Extension - with L1B to L1A extension

    Hello

    My company recently filed for my extension of VISA along with the change of visa type from L1B to L1A. this was done through filing i129 form. It was also applied through regular processing as I had about 7 months for the expiration of my current L1B at the time of filing

    Now - it's been about 2 months and I have not received any response (either RFE or Approval/Denial). I have some question regarding the process.

    1. Is the timeline for i129 for an L1 individual the same as a timeline for an L1 extension?
    2. Where can I find the approximate time for receiving a response?
    3. I see the approximate timelines published on USCIS website (https://egov.uscis.gov/processing-times/). Is this only considered for initial response or including RFE time? I mean the current timeline in Texas Center says 3-5 months with a Receipt date of inquiry of October 23rd 2020. Does this mean most of the I129 petitions that were applied before this date are processed irrespective of whether they received RFE or not?

    90wolfpack The processing time mentioned on the website is not accurate. It might take 6-7 months on the regular processing. Its been only 2 months your petition was filed so I would say have patience as this will take time. Otherwise you can ask your employer to move the case to premium processing for the faster decision.

      That timeline is for initial response, any RFE will add extra time to the final outcome of the application.
