  • L1A question

    Hi All,

I have close to 2 years left with my L1A visa. My employer is going to do a GC for me but I wanted to ask, just in case if the GC is not approved in the next 2 year, can I get a new L1A or is it like once 7 years are completed, I never get new visa?

Once you file for your GC, you can continue to live in USA (and work as well, if you get your EAD before your 7 years completion).

For another L1A (if your GC or EAD is not done & you decide to leave USA), you need to work outside USA for an year (called cool-off period) & reapply for a fresh L1A.

Libra_14 thanks for quick response. Will it help if I at least get I-140. Can I still apply for new L1A from US before my current L1A expires?

I140/I485 & L1A are two totally independent process.

Having an approved I140 does not allow you to extend your L1A beyond 7 years.

But having an pending I485 & approved EAD will certainly let you stay & work in USA. Right now dates are current starting Apr 1st 2021 - you can file I140 & I485 concurrently.
