  • Question on 1 in 3 year rule for L1 visa

    Hi All,

    First of all thank you for reading this post. Upfront apologies for the length of this question and (perceived) complexity. My question is regarding my eligibility for L1-A visa.

    Here's my experience timeline.
    1. Masters degree in business administration. Started working in 2006 with Company A.
    2. Moved to US on H-1B from Company A in April 2013
    3. Changed employer in US in February 2014 and have been with that Company (Say, Company B) thereafter on H-1B. PERM and I-140 filed through Company B.
    4. Moved to Company B's Canada office in March 2020 and it has been just over an year with Company B Canada
    5. Now, Company B wants me to be back in USA on L-1A Blanket.

    Skills and managerial authority wise I would qualify but I am uncertain if the 1 in year 3 year rule (https://www.uscis.gov/news/alerts/us...nt-requirement) would invalidate my case? Could anyone please share their insights on the applicability of that rule in my case.

    Attached is a diagrammatic representation of my professional & immigration timeline.

    You are certainly eligible for L1A, what is the doubt?
