  • L1A visa - confirming understanding of dates

    Hello!

    My friend is currently living and working in the USA under an L1A visa.

    She is a bit unsure about the validity dates, and I was hoping to be able to give her some reassurance, as I think she is ok.


    On her passport itself, the visa dates are from 10 July 2018 to 5 July 2023.
    The original PED date on the visa is 05 July 2021.
    The visa also states “Blanket L1, must present I-129S at POE”

    She recently did an intra-company transfer, and she now has also a form I-797A, for the case type "I129 – petition for a non-immigrant worker”, with her current employer as the petitioner.
    The petition was approved, for the class L1A, and is valid from 8 March 2021 to 1st November 2022.

    So - for me - she is ok to work in the USA until end of November 2022.
    She can travel to her home country this summer to see her family, and she shouldn't have a problem to come back (in theory, notwithstanding evolving COVID context etc. of course).

    She will need to think about getting her petition to work extended before the deadline of November 2022, and she should also keep in mind that her L1A visa expires in July 2023.

    Thank you to anyone who might be able to confirm my understanding (or point out if I'm incorrect)!

    Here are the explanation of various dates:
    1. Visa expiry date - This date means she can use her visa to fly to any POE in USA & ask officer to admit her. At any time she is travelling to USA, she need to have a valid visa. Since her visa mentions that "must present I-129S at POE", she will need to have a valid petition as well at the date of her entry.
    2. Petition expiry date - This date shows till when she can "work" in USA. One can "work" in USA with an expired visa, but need a approved/pending petition to be able to work.
    3. I94 expiry date - This dates shows till when she can "live" in USA.

    So considering her visa is valid till "5 July 2023" her L1A petition is valid till "1 Nov 2022", she should not have any problem in leaving & returning to USA (of course president proclamation is separate thing) before 1 Nov 2022.
