  • EAD renewal on L1a/L2 extension notice

    # My L2 visa, I94 and EAD is going to expire on 15-Sep-10.
    # We have filed L1 and L2 extension on 26-May-10. We received RFE on 19-Jul. We are going to submit the RFE papers by 30-Aug
    # I applied for EAD renewal on 9-Aug with extension notice. I am called for biometric on 8-Sep.
    Does USCUS renew EAD based on L2 extension petition OR L2 approval is required?
    if yes on extension - how long? Will the EAD be effective from 16-Sep-10.
    I am not sure how long it will take for L1/L2 to get approved. I am working on W2.
    I want to keep working. Are there any cases like me? Any help will be appreciated.

    >>> If the EAD is not approved by Sept 15th, you have to stop working. YOu can continue working only after getting the EAD renewed. If you don't receive the EAD after 90 days from filing, then you can request USCIS to send you an interim EAD.

      Will the Premium Processing for L1 extension help? The USCIS can take up to 60 days after papers for RFE reach them. With Premium processing I think they have to respond within 15 days.
      Are there any chances of rejection because of premium processing?

        Premium is only for L1 and not for L2 or L2 EAD. When L1 & L2 are applied together and if L1 is in premium, it doesn't guarentee that L2 will also get the decision in 15 days along with L1.
