    Hi All,

    Current situation:
    Me and my wife are Indian citizen we are here in US since January 2010 and we hold L1/L2 visa valid till Dec 2012. Now that my wife is pregnant with 4 months, she wants to visit her parents in India for couple of months. So after 2 months from now, she would return back to US.

    Question:
    I want to know if my wife being pregnant with 6 months at the time of returning back to US might face any issues at
    1) Immigration checkpoint at the time of entering US OR
    2) At the time of exit from India?

    Does any one know if any one faced this issue in the given situation? Can immigration officer object and deny my wife entering US / exiting India?

    Please advise.

    She will be able to return back without any issues since the primary applicant (You) will be in U.S at that time. However, it is advisable to check with the doctor to to see if she is allowed to travel during her 2 & 3 trimester.

      Hi OP,

      Also some international airlines asks for a letter from the doctor that a person can fly while pregnancy . So you may require this while coming from India to US.

        There are no immigration issues. But most airlines will ask for Doctor's letter allowing air travel. Try to fly as far away from the due date as possible since long air travel can have serious health issues for her and the baby.

          Hi,

          We are not worried about baby since doctor has advised my wife to travel before 7 months.

          The main issue is I don't want her to stuck in India and Immigration authorities stopping her to enter US again just because they think she is coming to US to have our baby to earn US citizen ship. And if they stop my wife to enter again even her having valid visa that's the big trouble for us.

          What the plan I was thinking that she can leave for India in a week and she will stay there for 2 months and I can reach India for 2 weeks by mid of October and we both will come together by end of October. So, if we both are coming together, will it create any immigration issue?

          Please advise as we want to plan her travel at the earliest.

              Although there are no specific regulations prohibiting pregnant foreign nationals from entering the U.S., entry is allowed or denied at the discretion of the admitting U.S. Customs and Border Protection (CBP) Officer. If the CBP Officer determines that you are likely to become a ward of the government (meaning that the government must provide medical care because you do not have medical coverage while visiting the U.S.), you can be denied entry. When determining if you will be allowed to enter the U.S., CBP Officers take into consideration the date your child is due for delivery and the length of time you intend to stay in the U.S. In addition, they want evidence that you have sufficient medical insurance to cover any medical necessities while you are in the U.S. If it is determined that you do not have sufficient medical insurance to cover any unexpected or expected medical care while in the U.S., you can be denied entry. Additionally, if you are pregnant and entering the U.S. at a border port of entry via vehicle, be aware the radiation detection portals deployed at the ports do not emit any radiation, and do not present a hazard to you and your unborn child. Coming to the U.S. for the purpose of child birth is not a valid reason for travel.
