L1 renewed but passport Visa expired

  • L1 renewed but passport Visa expired

    I have just received notice from UCSIS that my L1 has been approved for another 2 years and I have a new I-94 until 2012 however my passport visa has expired.

    How can I get the passport Visa renewed so that I can travel out of the US and get re-entry without having to return to my home country?

    I can't afford the time or money to return to my home country and then have to wait for the interview etc that we had to do the first time around - surely there must be an easier way?

    Thanks for any advice on where to start looking

    You can stay in U.S as long as the extended I-94 is valid. If you leave the country, then you need to go through the same process that you did the last time around to get the visa stamped in the passport to re-enter (Since your visa has already expired). There is no easy way out. It is not required to go to the home country to get the visa stamped. You can get it done from any U.S consulate that accepts third country visa candidates (Example: Mexico, Canada).

      I have to travel to New Zealand for work so I will be able to apply to the US Consulate in NZ and get a new Visa - that will work out really well.

      Once the petition is approved, is there any chance of the Visa being denied? Or is it fait acompli at that point.

        Possible. However, if you carry all the required documents list in the below link and you were never out of status or accumulated any illegal stay, then you don't have to worry. If possible email the respective consulate to make sure that your petition information is the PIMS system. Sometime the visa could be delayed because of PIMS.
