  • L1A extension RFE, any impact on green card

    Hello,

    I have filed my L1 extension (L1B to L1A), and recently I have received RFE, however at the same time I do have approved I140 and received EAD, and waiting for I485/green card, so I have 2 questions:-
    1. In the worst case, if the L1 extension gets denied, will it impact my green card processing, when I have approved I140 and EAD?
    2. Since I have EAD to stay and work in the US, not sure why my attorney recommends retaining L1 and not withdrawing, that could have saved the pain of responding to RFE.

    any thoughts would be helpful.

    No, both are separate process & doesn't impact your GC.

    Its not required, but recommended to keep your non-immigrant status active, just in case any issue with your 485, you can fall back to your L1 visa & re-file/appeal your 485.

    On the other hand, if you leave your L1 status & any issue with 485 will make you leave USA immediately.
