  • L1A for Manager involved in technical and managerial duties

    Hi,
    My company has decided to apply L1A for me. I m currently involved in technical work as well as managerial. I have few reportees under me(involved in approvals/appraisals/review/etc).
    Little confused on the type of Visa to be selected. My attorney suggested to move with L1A? Do i need to debate/discuss again on this?

    Is there any clause for not getting involved in technical (foot soldier) work while opting for L1A? Not even a minimal % of technical involvement should be there?
    Will there be chances of RFE/rejection of my petition if i mention the same?

    Expert suggestions will help me.

    Well the definition of L1A doesn't say you cannot do technical work, but if you are involved in coding, it is considered a job of software engineer & can cause issue with your visa.

    I don't think you would want to risk your visa, just because you want to "mention" your coding habit in your petition.

      My job involves 50% technical and 50% managerial (functional and people - with very few reportee).
      so, worried on the less reportee part for filing L1A. I have good evidences of appraisals/approvals/task-delegation/etc and manage a critical function, to support though.

        Samnit,

        My L1A was just approved, and as per my understanding, you should have more than 50% duties as managerial. If this is the case and you're able to prove it, you will be eligible. L1A is better as compared to L1B, as your green card process is faster. I am myself very new to this, but this is what I've gathered. I would suggest going with whatever the lawyer says as they know best.

          1) Rejection rates are higher in premium L1A individual visa filing process when compared to regular? Is that true or a misconception ? I could find mixed responses regarding this query and so posting again, apologies for the inconvenience.
          2) Currently, I am performing 50% of L1A eligible managerial work and the other 50% of technical work ? Can this be a problem for visa approval ?

            Sorry for a dumb question -
            Can the evidences which i need to provide while filing petition be a mix of "People management" AND"Functional management" for qualifying for L1A or it should ONLY be either of them?
