  • L2 after GC

Recently my PD became current & I applied for AOS to become PR.

My family is outside USA & posses valid L2 visas.

Question : If my AOS application is approved next month, will they still be able to use their L2 visas to come to USA?

Have you also filed AOS for your family members? They should get their own green cards.

I remember a story from one of my managers who traveled at the time when her green card just got approved. Made for an uncomfortable wait at the airport until the officers figured out what was going on, but they did eventually let her in.

Just out of curiosity, what makes you think that you'll get your permanent residency so soon? Have you already done biometrics, interview and all? I haven't gone through my process myself so my knowledge in the area is limited, but from what I know, I-485 processing takes about a year.
I'm an L2 non-immigrant. My most recent I-539 and I-765 were submitted mid-Oct 2020, Texas SC and approved early August 2021.
Make sure to sign up for USPS Informed Delivery. USPS sent back my first EAD and it took 5 months to get it re-mailed in 2018-19.

Thanks Gina1808 my family lives outside USA when I filed my AOS my attorney filed I824 (Follow to join) for them. I filed my AOS last year, got biometrics done & hoping to have interview waived-off & get my GC in hand by end of this year.

Their L2 visa is recently expired & since embassies were closed, they were not able to secure visa so far (not eligible for dropbox) we got appointment for September 2021.

Assuming I get my GC by Sep/Oct 2021 & my family secures L2 visa. Will they be able to use their L2 to come over & convert their I824 to I485? Or they need to wait for their I824 to be approved, get their immigrant visa from consulate outside USA & visit me?

      Hope this clarifies the situation.

If they get L2 visas, and can come to the US before your AOS is approved, then they can do AOS in the US. Otherwise, once your AOS is approved, they cannot enter on L2 visas since you would no longer have L1 status, so their only option would be Consular Processing abroad.

This is my personal opinion and is not to be construed as legal advice.
