  • EAD Renewal being outside of the USA

    Hi!
I am L2 dependent of L1, since we are going to USA embassy for getting prolongation of my husband's L1, so as soon as out passports are done ( new L2 visa is added) I can apply for EAD renewal remotely. ( all documents will be ready and just waiting for new visa from passport to be added to them)
I was going through USCIS and couldn't find information or documents that are obligated me for being here in USA. From source https://www.uscis.gov/forms/filing-guidance/checklist-of-required-initial-evidence-for-form-i-765-for-informational-purposes-only my category would be a18 -> It's said I must provide I94 OR passport ( here it's not saying what pages should be added so I am assuming just page with a visa will be enough)

Could you please tell if it's valid option? If somebody has information on this issue?

No, you cannot get EAD renewed while you are outside the USA.

    Example discussion : https://www.immihelp.com/experiences...proved-419303/

It's said I must provide I94 OR passport ( here it's not saying what pages should be added so I am assuming just page with a visa will be enough)
It also says "lawful L nonimmigrant status"
Having a visa does not give the visa holder a "lawful nonimmigrant status", traveling to USA legally is needed.

    Refer : https://www.uscis.gov/sites/default/...t_Services.pdf

Anand A. Thanks. I see what are you referring to so basically my current I94 will be expired since I didn't re-enter USA with a new visa so my I94 wasn't updated. ( I am out of status till I re-enter).
One more question: In case I re-enter with a prolonged new visa so i94 is updated ... Can I go home and and wait there for EAD?

Yes, you should be able to travel after applying , which makes me wonder why they mandate one to be in US at the time of applying
However, like with any other USCIS thing, things are unpredictable. Foe example - Check this thread :https://www.immihelp.com/forum/ead-a...el-outside-usa
