  • L2 & EAD Extension & Does,the Biometrics dropped by USCIS helping?

    Hi All

For L2 & EAD Extension & Does, the Biometrics law dropped by USCIS helping?

Every month the processing time is progressing and then going a good number of days back. So I am wondering if biometrics was a stopper and now it is not then also processing time for I-539 and I-765 are not moving fast.

11 months and I am waiting for my L-2 extension approval and EAD extension with Texas Center :-( Cannot find anyone who got approval for both forms extension recently.

Can I try expediting 2nd time?

My biometrics was completed in December 2020 1st week.

    Thank You.

I highly doubt that biometrics was the only thing delaying the processing for I-539 and I-765. As you can see, in your case, it has been almost 7 months after biometrics.

And I also highly doubt that "courtesy premium processing" for L2 extension was not possible ONLY due to the introduction of biometrics requirements.
My L1B extension was filed in premium and RFE was issued. Biometrics for my spouse for L2 extension were collected before the RFE response was sent. Still, the L2 extension was not approved. If there was any "courtesy premium processing" restriction just due to biometrics, then both applications would have been adjudicated. It has been 3 months since L1B ext was approved and the L2 ext is still pending.

To me it seems "fingerprinting" was a scapegoat, not the real cause for delays. The real cause probably is the pileup of cases and then L2 is not the highest priority in that pile.

Can I try expediting 2nd time?
Yes, there is no limit on the number of times one can try to expedite. Although, it may be better to try a different route than what you attempted last time (USCIS / Congressman / Ombudsman). Can you please share your previous experience WRT expedite request on this thread https://www.immihelp.com/forum/usa-l...pedite-request ?

      Hi Anand

      My Timeline!

L1/L2/EAD renewal filed on July 30th, 2020 (Texas Service Center)
      L1 approval received on 15 Aug 2020 ( Premium Processing )
L2 biometric appointment completed in Dec 2020 1st week.
EAD extension expedite denied in Dec 2020
L2 extension expedite denied in Jan 2021 & L2 expedite denied again today 06/30

What a crazy legal immigration system and USCIS has no workaround for cases like mine and thousands out thr!

Expedite request is on auto mode to just reject. USCIS does not care. Coz they are broken and have no clue what to do with legal immigration systems.

L2 EAD is a privilege & not your right. They'll approve it once the high priority applications are processed. USCIS has huge backlog right now.

Thanks for the condescension but that's categorically false. Public Law 107-124, passed in 2002 by Congress, expressly directs that

In the case of an alien spouse admitted under section 101(a)(15)(E), who is accompanying or following to join a principal alien admitted under such section, the Attorney General shall authorize the alien spouse to engage in employment in the United States and provide the spouse with an ‘employment authorized’ endorsement or other appropriate work permit.

I didn't said L2 are NOT authorized to work. I said EAD for L2 is a privilege & will be approved on appropriate time.

                Hi
Apply for your expedite request again and hopefully u will get approval soon

i was in the same boat. Had my finger printing in Nov 2020 but was waiting for L2 extension and EAD till about a week ago. Someone suggested that I should chat with USCIS to submit the request. I told them the time lines and the fact that i am facing day to day hardships like licence renewal on top of work loss.

the request to expedite was accepted and within a week, both requests were approved

I think i got lucky. I got a formal email from USCIS that they r rejecting my expedite request. It seems that it was a pure coincidence that i raised an expedite request and my cases were approved through normal channels the same time. My L2 extension n EAD application was submitted in Aug 2020, so maybe that played into approval timeline

                      Glad it is approved :-)

Your receipt date is Aug 2020 for L2 and EAD. Mine is July 2020 still I have not received anything I don't know how they are processing cases like us.

Yours was Texas S Center? My application is in this center.
