Can I enter US on valid L1B, while holding H1B consular notify approval?

Hi,

I need to visit India this month for personal reasons and planning to return by early Oct 2021. I have a valid L1B visa till Aug 2022, but meanwhile I got my H1B approval notice starting from period of Oct 1st 2021, for which I have to visit consulate in India to get it stamped after October.

Since there are no free dates for stamping in next few months, I don't plan to get my H1B stamped in this visit. Since H1B approval notice mentions that it is valid from Oct 1st, will I still be eligible to return to US with L1B visa? or would the L1B visa becomes void from Oct 1 2021, because H1B is approved?

Hi,
Could you please confirm, you got H1B Approval with change of status? If Yes, then your status will be automatically changed to H1B from Oct 01 onwards. When you travel overseas, you will need to go for visa stamping on H1B in order to reenter to the USA.
Otherwise, If you got H1B with consular processing then it is your choice to convert your status from L to H1 through visa stamping. If you dont require to convert status to H1B then you can reenter to the USA on L visa.
