L1B intermittent to Full time

    Was previously categorized as L1B intermittent - only entering the US for 3/4 months of accrued time per year, employed by CDN entity. Not subject to 5 year total time limit and can renew L1B indefinitely. This has gone on for many years and I've probably accrued say, 2 years of total L1B time.

    Now considering switching full time to be employed by the US entity and residing full time in the US. Does all of my previous L1B time that I was intermittent now count towards the 5 year limit, meaning I would only have 3 more years? Or does my L1B "time" only start counting from when I disqualify from intermittent status?

    I did exactly this a few years back. Worked for our Canadian firm but on a US project traveling weekly, and then transferred to the US firm and moved to the US. The time all combines together. That said, You should have substantial recapture time against your 5 year max given all of the time spent out of the US. You could also consider down the line transferring to an L1A for the 7 year max, or if you’re all in on the US, a green card.
