  • Last name not present on Wife's Indian Passport (appyling L2)

Please guide me on below issue. I am currently in US on L1-B (blanket). My wife is in India and wants to join me here in US but does not have Last Name in passport.
Her name in her indian passport is "First Name: AAA BBB & Last Name: (blank).
My surname (last name) is JJJ. We have a valid marriage certificate and complete marriage album and is currently with my wife.

Option 1: Is she does not change anything on her passort, can she still apply for L2 ? Pls note that she does not have my name (as spouse name) on her passport. Also, she does have "Last NAme" as BLANK. She might want to work in USA also.

Option 2: Another option is getting her passport changed/corrected and add my surname as her "Last Name" in her passort and also add my name as spouse name on her passport. Once done, then apply for L2. Obviously this is the best way to go for.

    My questions are:
    1. If we go by option # 1, Will this be a problem for applying L2 and coming to US?
    2. Will applying for work permit later in US be a problem w/o last name? Is there any mandatory requirement for "Last Name" to be present on passport before applying for L2 (or any VISA for USA??)

OR do we have to go through option #2???

Any reply or response will be highly appreciated and I really thank you in advance, if you have any inputs for me...!!

    THANKS ALL!!

Getting a visa will not be a problem. However, it is strongly advisable to get the passport corrected, so that all her future records in U.S will hold the correct name.

If she doesn't have a first name or surname in the passport, her entire name will be printed on the surname field of the visa. Her first name will be printed as "FNU" (first name unknown).

By having "FNU" listed as her given name on her visa, she might have difficulty obtaining a proper driver’s license, bank account and social security card in the United States. All these documents will go as per the name printed in the passport/visa.

It is better to get this corrected now and then apply for the visa.
Not a legal advice. Use of this information is strictly at your own risk.

      Thanks Shervin.

Now we are looking for some help to get this corrected in her passport.
      1. Add my surname as her Last Name
      2. Add my name as spouse name in her passport.

Any idea, will she be getting a new passport altogether or same one with correction? Also another point is that she is now not staying in the address on her passport .
