  • L2 - ead

    Hi,

My husband is at US. I am going to travel on october 15th in L2 dependent.
I would like to apply for EAD process.

I have few queries on EAD process.

    1. How long will it take to get the EAD?

    2. What are all the procedures should I follow to apply the EAD.

    3. Is there any possiblity to make the EAD process fast.

    Thanks in advance.

      L2 - EAD based on I129 extension

      Hi,

      I have a different situation.

my L1 visa/I94 is getting expired by Dec 2010. But my spouse got a I-94 which is valid in Dec 2012. He applied a EAD and got one with validity upto my Visa/I-94 last date which is Dec 2010.

Now my employer is filing for my I129 extension. I am planning to apply for his EAD renewal once my I-129 petition is approved.

I am bit confused with I-539 form.

      1. If his I-94 is already valid till 2012, do I need to apply for I-539 or L2 extension ?

      2. Once my I129 is approved, can he apply for EAD renewal based on the new I129 date and his I-94 date?

Right now, my employer is processing only my documents .
Will it be ok or I need to ask them to file docs for my spouse also?

        >>> No. Extension of status can be filed only 6 months prior to the I-94 expiry date. You don;t have to file the extension now.

        >>> Yes.

        >> That is okay. You don;t need to file the extension for your spouse now.
