Kids I-94 date WRT to passport expiry date..Whats next ?

  • Kids I-94 date WRT to passport expiry date..Whats next ?

    I need some help here. I am on L-1 and my I-94 is valid upto 12th FEB 2012.
    My 2 kids are on L-2 and their passports expire on 10th DEC 2011.
    Recently when they came from india, at JFK , the officer stamped their
    I-94 date as 10th DEC 2011 due to their passport expiry dates.
    But their L-2 visa is upto 12FEB 2012.
    Any how, I am going to renew their passports by june 2011 (within 6months time period)...What should I do to renew their I-94 date to 12th FEB 2012
    as per their L-2 petetion date ?

    You can file their L2 status extension before their current I-94 expires. The EOS can be filed only 6 months in advance of the I-94 expiry date. If you have any plans of taking them outside the country, then upon re-entering U.S, they will get a new I-94 as per your L1 petition expiry date and their renwed passport (For that to work, you will need to surrender your their current I-94 before you leave the country).

      Hi OP,

      Frankly speaking there is not much difference between 10DEC2011 and 12FEB2012....
      what I mean to say that your I-94 is also valid till 12FEB2012 only - so you also need to extend your stay/I-94 before that and when you do that...and if your family is with you in US - then you can apply for them also along with your application....(make sure that their passport is renewed before that)
