I-130 approved. Currently on L2 Visa. Can I adjust status ?

  • I-130 approved. Currently on L2 Visa. Can I adjust status ?

    I’m the principal beneficiary of an approved I-130 family based petition (f4). My spouse and child are derivative beneficiaries on the same petition. My family and I are currently in the US on an L2 visa ( self and child) . My spouse is working here on an L1 visa. Am I eligible to adjust status for myself and my family ( spouse , child) ?

    Hi,
    Yes. You can do. Since you got I-130 Approval, now you can file I-485, if your date current.

        F4 currently has visa numbers available for petitions filed before March 2007 (or even longer ago for people born in India, Mexico, or the Philippines). It is highly unlikely that the I-130 took 14.5 years to approve. Therefore, most likely, it is still many years (possibly decades) away from a visa number being available for the OP's petition.

        And if one's visa number were available, one can file I-485 while I-130 is pending. So I-130 approval has nothing to do with ability to file I-485 at all.
