  • L-1B petition with passport expiring in 2 years

    Hi All,

I was just informed by my company's lawyers that I should have a passport which expires 6 months after my expected L-1B visa expiry (3 years). My passport expires in Nov of 2023, which is in 2 years.
They told me that theoretically all I need is a passport that's good for at least the next 6 months at the time of my petition, but recently foreign nationals have been asked to have passports expiring past their visa expiry.
Has anyone else had this experience and can provide some guidance?

Just for some more context: I am Canadian, will be petitioning at port of entry, and decision will be made on the spot by CBP, apparently.
Just want to make sure I won't have problems extending my visa once passport is renewed if I get approved for only the duration of my passport validity.

    Any input is appreciated!

    Hi,
Since your passport has validity of another two years, you are good to go. As per my knowledge, there will not have any issues at the time of port of entry verification.
    All the best.
    Thanks

Thanks for the information rkk09 ! I've decided I'll hold off on renewing and roll the dice.
Also, apparently not so easy to renew if your passport isn't at least 1 year away from expiration.

I'll post an update of my interview experience and outcome once the time comes.

If anyone else has any experiences interviewing for an L-1B they want to share (especially at port of entry) , I'd be interested to hear!

For anyone interested, here's a quick update on my L1B:
I called cbp to make an appointment at a point of entry, then a few days later drove down to interview. The process was fairly quick, took a total of about 45mins. But most of that time was taken up because there was a small mistake on my I-129 and I had to have my lawyers email cbp an amended form.
My passport expiry date was not an issue, the visa is valid for 3 years. I just have to make sure to renew my passport on time before it expires.
          Hope my experience helps others!

It's always essential to have the right documentation when it comes to visas and passport validity. While theoretically, a passport with at least 6 months of validity should suffice for many situations, it's also true that requirements can vary.
Given your specific circumstances, it might be a good idea to reach out to your company's lawyers for clarification. They can provide the most accurate guidance, especially considering recent changes in regulations for foreign nationals.
If you have any concerns or questions about passports and identification, you can check out **** id vendors. They can get you almost anything you need.
