L1 B to H1 B status changes

Hi All,

I am on L1 working for Company A and Visa is valid till May 2022. Company B is ready to file H1 for me in 2022. Also my husband has H1 B. I need some guidance regarding the situation-

1. If company A decide not to file L1 extension and company B file H1 that will start from Oct 2022, am I eligible to stay in USA from June to September.

2. if company A files L1 extension and Company B file H1 , then will it affect any Visa L1 or H1 ? Will one of the Visa Cancel? My preference is H1 so i am worried if My H1 will b impacted

3. If company A decide not to file L1 extension and company B file H1 that will start from Oct 2022, if i opt to go on H4 by that time , will it impact my H1 processing.

1. If company A decide not to file L1 extension and company B file H1 that will start from Oct 2022, am I eligible to stay in USA from June to September.
Answer: You will need to maintain status until you get H1B Approval( oct 01 or after). If you fail to proof your maintenance of status during these period, It will impact your H1B petition.

Answer: There will not be any issues on H1B petition. Anyhow, you will need to maintain status till September. So, Its suggestable to file L1 Ext.
3. If company A decide not to file L1 extension and company B file H1 that will start from Oct 2022, if i opt to go on H4 by that time , will it impact my H1 processing.
Answer: If you decide to file change of status to H4, Please make sure to file H4 change of status petition before L1 status expires. If you follow the same, then you will not have any issues to file H1B petition.
