    Hi,

    My wife recently got her L1A approved. She was in US already on H4 visa. My question is, is there any duration within which she has to be on the payroll of her employer. We have to move to a different state, so it may take some time before she can start working from office (there's no remote work option available).

    There is no rule, as to when she start working on the L1 petitioner.

      Thank you for your response!

      We are actually planning to travel to our home country to visit our family. And I understand that she will have to get L1A stamped on passport before returning to US. So, will there be any issue in her stamping? We have heard of some past cases, where either 221(g) was issued or visa was cancelled during the stamping. I also haven't found much information on this forum regarding H4 to L1A. So we were little scared of travelling.

        Usually there won't be any issue. This is a normal situation people switching their non-immigrant visa.

        In case if they found you ineligible for L1A, you both are still married & it won't hurt her H4 visa (they do cancel old visa in case if that is not valid anymore, like switching organization).
