  • I-129S expired but visa & I94 still valid. Can I remain in the U.S. without working?

I'm on an L1B visa (blanket petition) and my I-129S is about to expire. I'm currently applying for an extension but I'm wondering about the worst case scenario if my extension request gets denied. The dates on my visa (in passport) and on my I94 are still further out (end of 2022), so I'm wondering if I am allowed to remain in the U.S. after the I-129S is expired. To be clear, I know that I wouldn't be allowed to work, so I'm really just wondering if I could still remain in country without working until the I94 is expired.

    Hi Member,
If your extension petition is denied then you will need to leave the country or take action on change of status petition. You will have a grace period of 60 days. Please note, I-94 or sixty days grace period, whichever is lesser, you will need to consider that date for leaving the country or taking action for change of status.
    Thanks
