  • L2 visa interview when L1 has not done stamping

    My Husband is in US already with L1 visa. His visa has expired in September 2021 and is being renewed by USCIS and is expected to be approved by mid-Jan,2022.

    I have booked an L2 visa appointment by Jan end by when he will get his petition approved. But he wouldn't have done his stamping by then as he would still be in US.

    Will it be a problem for my L2 visa interview as L1 petitioner visa copy on his passport will have expired dates?

    Help appreciated.

    You would not be able to have your L2 visa stamping until the primary applicant l1 visa goes for visa stamping first or plan stamping with you. L2 is a dependent visa on l1.

      Here is my response.

      Answer: Since your primary applicant was filed L1 Extension just want to make sure, have they filed even L2 petition too( If you are in the USA. If you are in India then just forget about L2 petition)?
      If not and you are in India then no issues. Once the primary petitioner get L1 Extension approval, with that you can go for visa stamping and get visa stamped then travel to the USA. L1 Applicant needs visa stamping if he leaves the country and when he comes back to the USA again.
