Hi all, I have a few questions in regards to L1A/B visa to permanent residency. I will be relocating to the U speed test S on a L1B visa (company has a blanket waver in place already), my company (a big multinational in the finance space) told me they will apply in my behalf for permanent residency. So from what I have already understood from here is that I will have to apply for a labor certificate first? Is that right ? Also when can this process be initiated , I read everything from instantly to 12 month. I am discussing this with our lawyers as well b showbox ut it would be good to get an non-company biased response first to see where I stand. thanks in advance

Hi Member,
Here I am sharing few points for your convenience.
1. If your Employer filing GC under EB1 category then you dont need Labor certificate.. Employer can directly file I-140 petition..
2. If Employer is going to sponsor your GC under EB2 or EB3 category then you will need to start from PERM which is LABOR filing.
3. This process will take anywhere between 1 to 1.5 years to complete I-140 petition.
4. For filing an GC, it is not compulsory, you will need to be in the USA. While you are in your home country itself, it can be sponsored and processed by Employer.
