  • L2 I-94 on I-797(notice of action)

    Hello All,

    As we all know there is a new policy for L2 dependents which allow them to work based on I-94. My I-94 is expired and waiting for L2 extension approval. Can I work using my I-94 in I-797A(Approval Notice) which I am going to get after the approval?

    Do you have any update on this: Does L-2 spouse may work with L2S status in I-797 A approval notice ? My Spouse is currently on L2 and has expired visa and stamp. We received I-797A approval notice with L2S status. Please advice. Thanks

      No, you need to have a EAD to be able to work. The new rule only allows to continue working, while waiting for EAD renewal.

      That rules doesn't allow anyone to work - who never had EAD.

        This is incorrect. L2 spouses are now authorized to work incident to status (without an EAD), and an I-94 marked "L2S" is sufficient proof of work authorization for the I-9.

        This is my personal opinion and is not to be construed as legal advice.
