  • L1B visa stamping after i-797 is approved

    Hi,

    I came to L1B blanket visa in Feb 2019 while my wife & kids are on L2. My visa got expired in Jan 2022 but my employer filed COS which got approved (L1B extended) last month. COS is still pending for my dependents.
    I have approved i-797 and I need to travel to India. Should I apply for L1 Blanket visa appointment for getting mine & my dependents visa approved? Or it has to be L1b individual drop box?
    As of now drop box appointments are not available. Can I apply for L1 blanket interview though I have approved i-797?

    I believe it will be EOS (Extension of Stay/Status) not COS (Change of Status).

    Since you've an approved I797 in your own name, you are no longer on blanket petition anymore. You'll need to file for visa renewal based on Individual petition. You can apply for drop box for yourself as well as your family.
    Since your family's EOS is not yet approved. Keep proof of family's EOS petition (receipt) to prove that they did not overstayed in USA.

    No, your's is Individual petition, you cannot apply for Blanket interview anymore.
