  • L1 Premium Processing USCIS - L2 lead times and process

    Hello
    Needing some more assistance on a new scenario! Husband L1 has been received by USCIS for premium processing. I'm told my L2 will take longer.
    IF and when his L1 (I-797) is approved -

    Q1. am I permitted to leave and re-enter the USA? Or do I need to wait for mine to be approved?
    Q2. can I go alone to the Consulate in Ireland and do my process - as he is approved and I'm a dependent, or does he need to be with me?

    Essentially - I need to be able to travel back and forth US><Ireland and I am not getting any clear guidance from our Company Attorneys as to HOW I can do this!

    Need more information to be able to help you better.

    Are you already in USA?
    If yes, which visa/status?
    What are your visa & petition expiry dates?

    Assuming you are in USA on L2 visa, you are allowed to leave USA & re-enter back with your own valid L2 visa & copy of your husband's L1 petition approval.

    If you need a new visa, you can get that alone. You just need to prove your relation with primary L1 holder & approved L1 petition copy.

    In short, as long as primary L1 holder is maintaining his status in USA, dependents doesn't have any issue travelling in/out of USA, getting new visa etc.

      H4 and L2 will be able to use Premium Processing, as they can file I-539 Applications for Extensions or COS. However, premium processing will become available for general applications for Extension to Non-immigrant status and Change of Status as well. This will include a wide range of visas.
