  • Need guidance on L1 Visa

    I am currently on L1B working in USA since September 2021 and my L1B visa is valid until July 2024. I have below questions before I start considering moving back to India within same company for a while due to personal reasons. 1. If I plan to move to US again in future and given my visa validity is until July, 2024, is there a cut-off date before which I should come back in order to start the L1 extension process? Is it recommended to get a L1A visa (I am promoted to a manager now) in order to fall into EB1 category? 2. Or can I still be on L1B visa and process my GC on EB1 when I come back? 3. I have a PERM process going on and the current status is 9089 accepted. Will this process continue when I move to India or will the PERM process abort when I move to India.

    You need to return to USA before July 2024 to be able to get entry into USA & than file for extension.

    Certainly, Eligibility criteria for EB1 & L1A are same, hence its easy to get EB1-GC while on L1A. You can still file under EB1 while on L1B, but you may expect RFE or questioning or denial.

    Yes, L1 & GC are 2 totally different process. One can apply for EB1 without even having any visa for USA or living in USA.
