Product Manager in Tech in moved from India on L1B, What next EB1 or L1A First?

  • Product Manager in Tech in moved from India on L1B, What next EB1 or L1A First?

    I recently moved to the US from India on L1b. I am a Senior PM in Tech. Overall exp of 12 years. My company wants to start the GC process for me now. Which option is the best?
    1. Apply in EB1C Directly - Like Typical Product Managers, I manage the functions of my Product (Design, QA, Engineering) and I'm responsible for a key product . What's the chance of the EB1C getting approved from an L1B?
    2. First convert from L1b to L1A and then Apply it to Eb1C to have better chances of getting EB1c
    3. Apply for the h1b lottery for backup and apply for Eb1 but my spouse will lose work status

    Please help , Let me know if any in similar situation has navigated this ??

    As far as I know, EB1C is only applicable for people on L1A Visa. Those who are in L1B qualifies for EB2 or EB3.

      Working in USA on L1B & then applying for EB1 contradict themselves. Legally you can go with that route, but then you'll have to prove that you changed your role from Specialized skill (L1B) to International manager (EB1C).

      Go ahead & apply for H1B as backup anyways. You can have multiple approved petitions/visas ay anytime, but you'll have only 1 status (L1 or H1) at one time.

      That's not true. Any one (without USA visa) can apply for EB1C.

      The basic eligibility criteria for L1A & EB1C is almost similar, hence if someone has L1A, EB1C is straight case for him.

      People on H1 or L1B visa faces a lot of difficulty proving that they qualify for EB1C, hence companies & attorneys do not go that route.
