  • Seeking advice for applying L1 while having H1 and i140

    Dear Friends,

Thanks in advance for your time and support!

I am on H1B (currently playing IT Technical architect role) and have I140 (EB3) through H1B (priority date: Dec2019). My employer planning to send me to Canada for a long-term assignment to setup and maintain new program as a Project Manager (it will go for 1 to 2 years). Upon successful completion of the assignment in Canada, I was given the option to come back to the USA to continue playing the same Project Manager role. As the role is differ from my H1B petition, they will file new visa on L1A visa category. Also, my employer planning to apply EB1 GC category after my return to USA in L1A as I will continue doing the manager role and also am with my employer for more than 12 years. Considering this situation, the new EB1 GC processing will have any impact on my old I140 (EB3)? is there any other issue that I should be aware of in this process?

Should not be a problem, a lot of people waiting for long on EB2/3 does that by leaving USA for an year, get new L1A & file EB1C.
