  • Wife on J1 changing onto L2 as my dependent

    Hi Everyone,

I am in the US currently on a blanket L1 visa. My fiancé moved here on a F1 a few months before me to start her degree.

Following my arrival in the US we have got married and now we are looking to have my wife move onto an L2 visa as my dependent.

To speed things up we are taking the route of applying directly via DS-160 for her to get the L2 visa by flying back to our home country to do the interview as opposed to pursuing the lengthy Change of Status route.

When we got married she changed her last name to mine on the marriage certificate. But we have not changed her name on any other documents yet (Passport, Drivers License etc). When she was completing the DS-160 she put in her old maiden last name as this is what her passport says, not her new last name that is on the marriage certificate.

Will this cause any issues when she goes for her L2 visa interview as she will obviously have to provide the marriage certificate as evidence of our marriage, and it will show her new last name?

We were also considering applying for a new passport before the visa interview with her new last name, but now that she has applied on the DS-160 with her old maiden name not sure if she should. I am also worried that if she gets a new passport and for some reason they deny the L2 then what will happen to her F1 visa in her old passport?

Is there anything else that I might not be considering that could cause an issue?

Many thanks for all your help and advise.

    Marcus

Her J1 doesn't have a 2-year home residency requirement, right?

This is my personal opinion and is not to be construed as legal advice.

Sorry I wrote that my wife is on a J1 visa when I meant F1 visa. I've corrected it above.
